Terms of service

Effective and last updated:

The terms for using Tullia’s AI-assisted campaign and customer-journey service.

1. Your agreement with Tullia

Tullia is a service of Jacob Perks, trading as Thunkle, a sole proprietorship in Ottawa, Ontario, Canada. These terms govern your use of tullia.ai and the Tullia application. “You” means the individual using the service and, if you act for an organization, that organization. Contact jacob@thunkle.ai with questions.

By creating an account or using the service after being shown these terms, you agree to them. You must be at least 18, able to enter this agreement, and authorized to act for any organization whose data or accounts you use. If you do not agree, do not use the service. A separately signed agreement takes priority where it expressly conflicts with these terms.

2. What the service does

Tullia helps business teams draft, review, and operate marketing campaigns and customer journeys using AI and connected services. Available features may include CRM synchronization, generated content, audience rules, delivery through authorized channels, and activity reporting. A listed integration may require its own subscription, credentials, permissions, or setup before it can work.

Tullia is not affiliated with or endorsed by HubSpot, Google, or the other providers it integrates with. Automated checks and AI suggestions assist your work but do not replace human review, professional advice, or your compliance obligations.

3. Accounts, workspaces, and demo access

Protect your sign-in email, provider account, and integration credentials. Use accurate information, assign access only to authorized people, and notify us promptly of suspected misuse. Workspace owners are responsible for membership permissions and the activity they authorize.

Demo workspaces are shared demonstration environments, not private accounts. Do not enter confidential information, real customer data, or live integration credentials into a demo workspace.

4. Your data and instructions

You retain your rights in materials and customer data you supply. You grant us permission to host, copy, transmit, and process them only as reasonably needed to provide, maintain, and protect the service, follow your instructions, and meet legal obligations. Our privacy policy describes personal-information handling.

You must have the rights and lawful authority to upload materials, connect third-party accounts, process contact data, and instruct messaging. You are responsible for appropriate notices and consents, the accuracy of contact and suppression records, and responding to your customers’ requests. If your use requires a data-processing agreement or specific safeguards, arrange those with us before submitting the affected data. These terms alone do not promise compliance with every jurisdiction or regulated industry.

5. AI output and approvals

You may use generated output for your business, subject to applicable law and third-party rights. To the extent we hold transferable rights in output created for you, we assign those rights to you. This does not transfer our software, templates, branding, or third-party materials. AI output may be inaccurate, incomplete, non-unique, or ineligible for intellectual-property protection.

Review content, claims, recipients, channel settings, timing, and consent before approval. Approving a journey authorizes its configured automated steps, including later scheduled actions and retries. Pausing a journey cannot recall a message already delivered or necessarily stop work already accepted by a provider. Maintain oversight of campaigns and connected systems.

6. Acceptable use and messaging

Do not use Tullia for unlawful, deceptive, abusive, discriminatory, infringing, or harmful activity; impersonation; phishing; malware; unauthorized access; or attempts to bypass permissions, usage limits, or security controls. Do not upload credentials into prompts or submit unnecessary financial, health, identity-document, or other sensitive personal information.

Do not send spam or use purchased, scraped, or otherwise unauthorized contact lists. Comply with applicable messaging and privacy rules, including consent, sender identification, and effective unsubscribe requirements under Canada’s Anti-Spam Legislation where it applies. Honor opt-outs and provider rules. A Tullia QA result is not proof that a campaign is lawful.

Do not overload the service, interfere with other customers, or resell access without our agreement. We may apply reasonable technical limits to protect reliability and prevent abuse.

7. Plans, billing, and cancellation

A paid service begins only when you accept an offer or order that states the price, currency, billing frequency, included usage, and any trial or renewal terms. Creating a Tullia account or using a demo does not by itself authorize a charge. No specific price or trial allowance is promised by these terms.

If you select an automatically renewing subscription, renewal and cancellation follow the terms disclosed at checkout or in your order. Cancel before the renewal date using the available billing controls or by contacting jacob@thunkle.ai. Taxes and third-party integration fees may be additional where disclosed or legally required.

Unless an offer or applicable law says otherwise, fees for a service period already begun are not refundable. Report an incorrect charge promptly so we can investigate. We will give advance notice of material price changes for future periods as required by law. Nothing here removes mandatory cancellation, refund, or consumer rights.

8. Availability and external providers

We may maintain, update, or change the service and its limits. We do not guarantee uninterrupted availability, delivery, a particular AI response, or any marketing or business result. External providers control their own uptime, account approvals, policies, rate limits, and fees.

Keep appropriate copies of important source materials and campaign records. Beta or experimental features may change or be withdrawn. If we discontinue the service, we will provide reasonable notice where practical and address any prepaid unused service as required by your agreement and applicable law.

9. Suspension and ending the relationship

You may stop using Tullia and request account closure by contacting jacob@thunkle.ai. Cancel any active paid subscription separately as described above. Data requests and retention are addressed in our privacy policy.

We may restrict or suspend access where reasonably necessary to address a material breach, non-payment, legal requirements, or a security or abuse risk. Where practical and lawful, we will explain the issue and provide an opportunity to resolve it. Ending access does not erase accrued payment obligations or provisions intended to continue afterward.

10. Disclaimers and limits

To the extent permitted by law, the service and generated materials are provided as available, without additional warranties of accuracy, merchantability, fitness for a particular purpose, or non-infringement. You are responsible for deciding whether the service and output are suitable for your use.

To the extent permitted by law, neither party is liable to the other for indirect or consequential losses arising from this agreement. Our aggregate liability relating to the service is limited to the fees you paid us for it in the twelve months preceding the event giving rise to the claim. These limits do not exclude fraud, willful misconduct, or liability and remedies that applicable law does not allow the parties to exclude or limit.

11. General terms and updates

Ontario law and applicable Canadian federal law govern this agreement. Disputes may be brought in Ontario courts, subject to any mandatory right to bring a claim elsewhere. Nothing in these terms overrides non-waivable rights under the law that applies to you.

We may update these terms prospectively, with reasonable notice of material changes. If a change requires new agreement, we will request it. If a provision is unenforceable, the remaining provisions continue to apply. Neither party’s failure to enforce a provision immediately waives its rights.
